    Digital transformation (DT) has not only been a major challenge in recent years, it is also supposed to continue to enormously impact our society and economy in the forthcoming decade. On the one hand, digital technologies have emerged, diffusing and determining our private and professional lives. On the other hand, digital platforms have leveraged the potentials of digital technologies to provide new business models. These dynamics have a massive effect on individuals, companies, and entire ecosystems. Digital technologies and platforms have changed the way persons consume or interact with each other.     Das Entstehen der Plattformökonomie und die damit verbundene Konzentration von Datennutzung und -zugang sind zentrale Zukunftsherausforderungen für Handwerksunternehmen. Diese Studie untersucht die Entwicklungen der Plattformökonomie und deren ökonomische Auswirkungen für das Handwerk. Dafür ist die Studie in zwei Abschnitte gegliedert: Der erste Teil erläutert theoretische Grundlagen und Funktionsweisen der Plattformökonomie. Im zweiten Teil wird empirisch auf Basis von Experteninterviews die Entwicklung von Plattformökonomie und Datennutzung im Handwerk untersucht. Hierfür werden zunächst die aus Expertensicht derzeit wichtigsten Plattformen identifiziert und eine Zuordnung zu den verschiedenen Typen von Plattformen vorgenommen.

    Die Digitalisierung verändert auch im Handwerk Arbeitsmittel und -prozesse, die Möglichkeiten der Kundenakquise und Geschäftsmodelle. In der vorliegenden Studie werden die Auswirkungen dieses Wandels auf die Anwendbarkeit der Handwerksordnung und die Adäquanz der rechtlichen Rahmenbedingungen untersucht. Im Fokus liegen die Abgrenzung des Handwerks von der Industrie anhand des Merkmals der Handwerksmäßigkeit, die Abgrenzung des stehenden Gewerbes vom Reisegewerbe und die Einordnung des jeweils maßgeblichen Betriebs bei verschiedenen Plattformtypen. Es werden jeweils konkrete Vorschläge für eine zukunftsorientierte Auslegung oder Weiterentwicklung des Rechts gegeben. Digitization is changing work tools and processes, customer acquisition opportunities and business models in the skilled crafts sector. This study examines the effects of this change on the applicability of the Crafts Code and the adequacy of this legal framework. The focus is on the demarcation of skilled crafts from industrial production, the demarcation of the stationary trade from the itinerant trade and the identification of the operation unit that is relevant for the applicability of the Crafts Code in different platform models. This study examines the aspects concerned and points out options for a future-oriented interpretation of the current law as well as for its further development.

    Crowdworking is a new organizational form of work that is attractive for both employees and companies. A great advantage is the flexibility of the design and the need-based access to certain services. Work processes can be made more efficient and flexible. Crowdworking has not yet become an integral part of the labor market. The volume of work performed by crowdworking cannot yet be adequately determined. However, it can be assumed that the Covid 19 pandemic threatens an economic slump that will lead to a reorganization of the work organization. Many employees already "practice" this decentralized form of work in their home office. Employees will be organized in various forms. Employees affected by layoffs will increasingly seek a new form of employment through crowdworking and will be forced to become self-employed in this way. Companies will reorganize the work for both the permanent internal employees and delegate many services - depending on requirements - to external crowdworkers via platforms. It is to be expected that the Federal Labor Court will deal with the legal framework of crowdworking in 2020 and will very likely set new guidelines, not least due to the revision approved by the State Labor Court in Munich. Crowdworking is becoming increasingly important in the world of work, which is why there is a great need for clarification for everyone involved. The principle of freedom of contract applies in Germany, but de facto the negotiating power and freedom of design of the crowd worker compared to the mediating platforms is very limited. In the meantime, clients and platform operators are well advised to limit possible risks when employing crowd workers by carefully drafting contracts. Minimum remuneration standards would be a first sensible step. With the new EU Directive 2017/0355 (COD), legislators are required to set up clear and unambiguous "guard rails" for crowdworking. The constantly changing world of work currently demands a high degree of flexibility - both from companies and from employees. Therefore, the legislator should define the term crowd worker in the labor law sense, not least to maintain social peace in the world of work and in society.
