    The world is going through a period of change. Volatile economic growth, climate change, the technological revolution, migration and the demographic transition all reflect this, as do the impacts these changes are having on society and the challenges they pose for public policies. Continuing the social progress made in Latin America and the Caribbean, ensuring no ground is lost and attaining the Goals of the 2030 Agenda for Sustainable Development while ensuring that no one is left behind will require new and greater public policy efforts to enhance coverage and quality. An essential part of this is to have institutions capable of meeting current and future challenges, securing viable and sustainable achievements and guaranteeing the universal exercise of rights.This book reviews elements of the institutional framework for social policies in the region, particularly those focused on social protection. It thus discusses the leading concepts and the progress made at the regional and national level within a framework of four complementary analytical dimensions: the legal and regulatory dimension, the organizational dimension, the technical and operational dimension and the financing dimension.     Han pasado 30 años desde la adopción del Convenio sobre Pueblos Indígenas y Tribales, 1989 (núm. 169) de la Organización Internacional del Trabajo (OIT) y, a pesar de que los Estados de América Latina reconocieron plenamente los derechos de los pueblos indígenas, este continúa siendo uno de los colectivos con mayor rezago en materia económico-social, aun cuando la región ha logrado grandes avances en este ámbito.Un importante reto que enfrenta la región es la construcción de sociedades pluriculturales, inclusivas, equitativas y no discriminatorias. En este escenario, la Agenda 2030 para el Desarrollo Sostenible constituye una oportunidad para la plena inclusión de los pueblos indígenas, que conlleva el desafío de comprender el paradigma del buen vivir, tanto para repensar el modelo de desarrollo vigente como también por sus implicaciones en la garantía de los derechos de estos pueblos.La Comisión Económica para América Latina y el Caribe (CEPAL) y el Fondo para el Desarrollo de los Pueblos Indígenas de América Latina y el Caribe (FILAC), consecuentes con el compromiso y el desafío de visibilizar la situación de los pueblos indígenas, presentan en esta ocasión conocimiento actualizado relativo a los derechos territoriales y la situación de los bosques, la demografía y el derecho al bienestar de estos pueblos. Se espera que ello contribuya al seguimiento de la implementación de la Agenda 2030 y a las acciones urgentes que se requieren para acelerar el cumplimiento de los compromisos asumidos por los países de la región.     Long description: Viele Arbeitsverträge enthalten Klauseln, die einen Tarifvertrag in seiner jeweils gültigen Fassung einbeziehen. Bei einem Betriebsübergang stellt sich die Frage, ob der Erwerber an diese zeitliche Dynamik der Klausel gebunden ist oder ob sie fortan nur noch statisch gilt. Tobias Möller analysiert, wie sich das europäische Recht zum Übergang von zeitdynamischen Bezugnahmeklauseln verhält. Dabei setzt er sich kritisch mit den EuGH-Entscheidungen Werhof, Alemo-Herron und Asklepios auseinander. Er gelangt unter anderem zu dem Ergebnis, dass die Betriebsübergangsrichtlinie die Beibehaltung der Dynamik zwingend verlangt und dies nicht zu einer Verletzung von Grundrechten des Erwerbers aus der EMRK oder der Grundrechtecharta führt.     Abstract: "Neben der Europäisierung der Politik und der Globalisierung der Ökonomie ist die Wiedervereinigung eine weitere große Herausforderung für das deutsche Modell industrieller Beziehungen. Anhand der Folie des 'Modell Deutschland-Ansatzes' wird geprüft, wie sich die Ausdehnung der Tarifautonomie auf die fünf neuen Länder bei den Gewerkschaften, Arbeitgeberverbänden und in der Tarifpolitik auswirkt (1990-2000). Untersucht wird dies am Beispiel der Metall- und Elektroindustrie, dem größten und einflussreichsten industriellen Sektor der Bundesrepublik. Zentrale These: Ostdeutschland ist trotz vieler Abweichungen, die vor allem mit der klein- und mittelständischen Industriestruktur zusammenhängen, kein Laboratorium, in dem ein neues Muster industrieller Beziehungen entsteht, das den historisch gewachsenen Pfad des westdeutschen Modells verlässt.     Contrary to the predictions of the insider-outsider model, we show that the large majority of outsiders in developing countries support, rather than oppose, protective labour regulations. This evidence holds across countries in different regions, across different types of protective labour regulations (i.e. severance payment, minimum wages, working time), and for different categories of outsiders (i.e. unemployed workers and employees without access to legally mandated labour benefits). We revise the economic and political assumptions of the insider-outsider model, discussing their empirical relevance in a developing country context.

En este escenario, la Agenda 2030 para el Desarrollo Sostenible constituye una oportunidad para la plena inclusión de los pueblos indígenas, que conlleva el desafío de comprender el paradigma del buen vivir, tanto para repensar el modelo de desarrollo vigente como también por sus implicaciones en la garantía de los derechos de estos pueblos.La Comisión Económica para América Latina y el Caribe (CEPAL) y el Fondo para el Desarrollo de los Pueblos Indígenas de América Latina y el Caribe (FILAC), consecuentes con el compromiso y el desafío de visibilizar la situación de los pueblos indígenas, presentan en esta ocasión conocimiento actualizado relativo a los derechos territoriales y la situación de los bosques, la demografía y el derecho al bienestar de estos pueblos. Se espera que ello contribuya al seguimiento de la implementación de la Agenda 2030 y a las acciones urgentes que se requieren para acelerar el cumplimiento de los compromisos asumidos por los países de la región.     This paper addresses the following question: how can we reconcile workers` rights and social protection with firms` competitiveness and productivity? In Latin America, there is an intense debate about the perverseness of the labor law (claimed to be harmful both to workers and to firms) and, in response, current policy advice emphasizes deregulation and the flexibilization of existing labor rights. In contrast to the standard policy advice, this research demonstrates that there are more "degrees of freedom" to reconcile workers` rights with competitiveness when one focuses on the implementation of the labor law. I investigated the street-level work performed by labor inspectors in two Brazilian states (Minas Gerais and Bahia) and I found out that in some cases labor inspectors have been able to implement labor law in a way that promotes both the improvement of working conditions as well as firm upgrading. My findings suggest that labor inspectors have been able to promote these outcomes-such as alternative arrangements for formally hiring short-term rural workers or technical measures to promote safer working conditions without jeopardizing firm`s productivity, for example-by combining both punitive (e.g., fines, sanctions) with pedagogical (e.g., technical and legal assistance) enforcement strategies.
