Abstract: "The economic and political rise of China has led to considerable controversy regarding potential repercussions for the current global governance architecture. At least two opposing scenarios are conceivable: China's adaptation to the rules and norms system shaped by developed countries or the pursuit of a distinctive policy approach, a possibility that involves the danger of clashing regulatory policies. A recent and increasingly dynamic trend giving substance to the phenomenon of China's rising importance is the growth of outward foreign direct investments (OFDI) by Chinese enterprises. Against this background, the present paper investigates the evolution and change of Chinese international investment policy-making, with a particular focus on bilateral investment treaties (BITs) as the most important legal instrument for the governance of global foreign direct investment (FDI) flows. China has been a committed signatory of BITs since the early 1980s (120 treaties up to 2007). It

Abstract: "This paper argues that although there are good reasons why poor countries in Sub-Sahara Africa (SSA) should support their agricultural sector, applicability of protective policies in the agricultural sectors of SSA is limited by various legal, economic, social, political and administrative reasons. The remaining scope, however, could be used to develop prospective agricultural sub-sectors for growth, poverty alleviation and food security, while protection should be embodied in comprehensive development strategies. These strategies must address the problems of low price transmittance of border measures and high transaction costs (in the largest sense) for agricultural products and particularly the limited supply capacity of small scale producers. Legally, trade policy in the case study country Senegal as well as in many other SSA countries is restricted much more by regional trade agreements than by the World Trade Organization (WTO). This is a formal and political reason why the p

Zusammenfassung: Trade agreements can contribute to long term development - and thus to addressing the causes of flight and migration - as long as they consistently pursue sustainable development and real market opening. The latest theoretical and empirical findings highlight the enormous complexity of the relationship between trade and migration. Other factors (such as war, economic crisis etc.) often play a larger role as triggers of migration than trade policy and trade agreements. One aspect is incontestable: Migration always has a positive effect on trade flows. Conversely, the effect of trade agreements on migration is sometimes positive, sometimes negative: If they lead to increasing per capita income they may temporarily stimulate migration. A certain level of income is required before people are able to emigrate at all. Using trade agreements to create legal migration opportunities in the area of services reduces the incentive for irregular migration. This question is especially relevant for the EU, as it faces the looming problem of labour shortages in the ageing societies of its member states. Ecological and social aspects of investment and trade should be better integrated in all free trade agreements. South Africa and the countries of North Africa offer the greatest potential to expand market access. The EU has already completely opened its markets to most sub-Saharan countries. The respective policy instruments for trade and migration need to be better coordinated in order to reduce the contradictions between them and to address justified concerns about uncontrolled immigration
