    At the zone of intersection between imagery, law, and the economy, the defamatory image is charged with a particularly explosive significance. Initially used as a judicial means of punishing debtors and other violators of contracts, defamatory images remain a vehicle for the denunciation and pejorative depiction of lawbreakers. This volume discusses the “magical force‎” exerted by defamatory imagery as well as the use of images in law. Im Grenzbereich von Bild, Recht und Ökonomie erhalten Bilder der Infamie und Diffamierung eine brisante Bedeutung. Wo im Spätmittelalter über eine Pädagogik der Scham die Schuldner bestraft werden sollten, um dem Schuld- und Vertragsrecht Beihilfe zu geben, stellen Schandbilder bis heute ein Mittel der moralischen Verurteilung und der diffamierenden Darstellung rechtswidrig handelnder Personen dar. Die Beiträge des Bandes diskutieren sowohl den mit ihnen verbundenen "Bildzauber" als auch die Bedeutung von Ehren- und Schandstrafen in der Rechtspraxis, wie der "pittura infamante" und dem Bildnisgebrauch im Rechtswesen im Allgemeinen.

    In the Renaissance period the body emerges as the repository of social and cultural forces and a privileged metaphor for political practices and legal codification. Due to its ambivalent expressive force, it represents the seat and the means for the performance of normative identity and at the same time of alterity. The essays of the collection address the manifold articulations of this topic, demonstrating how the inscription of the body within the discursive spheres of gender identity, sexuality, law, and politics align its materiality with discourses whose effects are themselves material. The aesthetic and performative dimension of law inform the debates on the juridical constitution of authority, as well as its reflection on the formation and the moulding of individual subjectivity. Moreover, the inherently theatrical elements of the law find an analogy in the popular theatre, where juridical practices are represented, challenged, occasionally subverted or created. The works analyzed in the volume, in their ample spectre of topics and contexts aim at demonstrating how in the Renaissance period the body was the privileged focus of the social, legal and cultural imagination

    Sampling - ein Dauerproblem für Ästhetik und Urheberrecht. Am Beispiel des musikalischen Genres des Mashups geht Frédéric Döhl der Frage nach, wann in auditiven digitalen Adaptionskulturen ästhetische Selbstständigkeit entsteht. Selbstständigkeit ist zugleich der Schlüsselbegriff für den Umgang mit Adaptionen im Urheberrecht. Dem ungeachtet findet sich das Mashup insgesamt in der Illegalität wieder. Als Antwort hierauf refokussiert die Studie das Urheberrecht auf den ästhetischen Gehalt des Selbstständigkeitsbegriffs. Dieser flexible Lösungsansatz ermöglicht es, weithin als kulturell bedeutend rezipierte Arbeiten wie das »Grey Album« (2003) von Brian Burton außerhalb der Illegalität zu positionieren - in welche sich Sampling-Praktiken wie das Mashup noch immer ohne Beachtung der kreativen Qualität und kulturellen Relevanz des Einzelfalls gedrängt sehen When is a piece of music aesthetically independent?
