    The present article aims to compare the regulatory and technical standardization systems in Brazil and Argentina, in order to examine the degree of convergence existing and possible between the two trade partners. Understanding the regulatory and standardization characteristics of the two countries is essential to analyze some of the acute problems of the integration process in Mercosur. The examination of regulations, technical standards and the regional instruments to regulatory convergence in these countries makes it possible to compare the level of compatibility between the two regulatory frameworks, as well as to formulate proposals for deepening the regional integration process within Mercosur.

    Since 2004, a complex high-stake assessment of the federal higher education system has been in operation in Brazil. Established by law, the National Higher Education Assessment System (Sistema Nacional de Avaliação da Educação Superior - Sinaes) consists of three components: the evaluation of student performance, the evaluation of programmes and the evaluation of educational institutions. This work makes a critical analysis of the quality indicators that guide such evaluation processes and regulate the accreditation of higher education providers and programmes. Based on this analysis, reforms are proposed focused on the programme evaluation component. The immediate objective is to make it more complete, simpler to understand, cheaper to run and more suited to contemporary trends. The ultimate goal can be either to ensure quality or to establish regulatory criteria - or both. The proposed reforms can also help mapping trends on inclusion and diversity on campuses, in addition to provide society with relevant information about the higher education system. The main recommendation is the discontinuation of the National Student Performance Examination (Exame Nacional de Desempenho dos Estudantes - Enade), and the replacement of the quality indicators currently based fundamentally on Enade results by a set of indicators based essentially on information extractable from administrative records existing in Brazil. The indicators presented are merely illustrative, but seek to cover four dimensions: efficiency, efficacy, effectiveness, and equity. It is argued that, at best, contributions made in the past by Sinaes are already insufficient to assess the federal higher education system. Restructuring it is necessary and a new evaluation system that is more advanced, cheaper, and effective can be designed to adequately replace Sinaes.

    The objective of this study is to analyze the response of improvements in the regulatory rankings of emerging economies to private investments in infrastructure especially for Brazil. The proposed methodology relies on a fixed-effect panel model. We further investigated whether, after the 2008 global crisis, there was a significant change in the perception of the private investor in relation to the regulatory and institutional characteristics of emerging markets. The study covers eighteen emerging economies - Argentina, Brazil, China, Chile, Colombia, India, Indonesia, Malaysia, Mexico, Pakistan, Peru, Philippines, Russia, South Africa, Thailand, Turkey, Uruguay and Vietnam, which represented around 89% of private investment flow to emerging countries and totaled US$ 1.3 trillion and 4.480 projects for emerging countries in the period of 2000-2018. The results are significant with the expected signal. The better the country’s regulatory quality ranking, the greater the volume of investments and the number of projects with private participation in infrastructure. The result is robust to several specifications and institutional characteristics added to the model. Finally, after the global crisis, model suggests there was a significant increase in the importance of the regulatory framework for decision-making and private capital allocation in this sector in emerging economies. If Brazil improves its position in the regulatory quality ranking to the same level occupied in mid-2000 (65th place, Colombia’s current position in 2018), this would lead to an increase of 0.81% of gross domestic product (GDP) in investments. If it reaches the Chilean levels (89th place), the increase would be 1.59% of GDP. Such value added to the current levels would total 3.4% of GDP, value somehow closer to the target of 4.25% of GDP estimated by the World Bank for a sustained growth.

    This paper describes and analyzes the trajectory of water and sanitation policies in Brazil, with emphasis on the Union acts on financing and regulation evolution in the sector. The objective is to point the different regulatory forms and models already tried, as well as to highlight the different forms of action of the State and the private sector and to discuss remaining challenges. The difficulties to overcome low regional rates of coverage of water supply services and, mainly, sanitary sewage that are listed on the Plano Nacional de Saneamento Básico (Plansab), Sistema Nacional de Informações sobre Saneamento (SNIS) and Pesquisa Nacional por Amostra de Domicílios Contínua (PNAD Contínua). We highlight the central elements and perspectives in face of current scenario of changes in Law 11445/2007, which provides guidelines, instruments and ways to finance services, giving water and sewage services a status of the infrastructure and health sectors. Among the conclusions we point: the recent advances in state and municipal regulation; advances and uncertainties in the changes in the regulatory framework under implementation; and the tendency to increase the weight of the tariff to investments. Suggestions are presented to improve the sanitation policy and its instruments, as well as for regulation and State investments in the sector.

    This study has as main objective to investigate if the energy markets liberalisation, in particular natural gas and electricity, contribute to the energetic transition, led by climate change mitigation policies. More specifically, this study attempts to classify the efficiency degree associated with the energetic transition of countries, taking into account the development state of the natural gas and electricity sectors. A data envelopment analysis is undertaken, more specifically using a Slack Based Measure model (Tone, 2001). This optimisation model compares decision takers units selected by pre-determined variables, which in our case are indicators of market liberalisation and energetic transition in the natural gas and electricity markets. The optimisation process will define an efficiency frontier, capable of classifying countries according to their relative efficiency. These results are presented and analysed with the objective of suggesting improvements in the regulatory framework and in the public ownership so that to improve the energy sector performance of the countries classified as lower efficiency performers relatively.

    This article analyzed the evolution of the regulatory system in the telecommunications sector in Brazil, incorporating important events that have been taking place since privatization, but have not been fully evaluated. Following the framework developed by Levy and Spiller (1993, 1994, 1996), the paper examined both governance structure and incentive model of the institutional context. From the evidences presented, it may be inferred that Brazil has a solid governance structure for the regulatory system. The stability of regulatory governance prevailed over political changes caused by government alternation, and this may be one reason of the continuous flow of investments from private parties in the sector since 1998. The incentive model, on the contrary, suffered from increasing tensions from institutions inside the federal administration. Lack of directives and policies for the sector, and absence of coordination between agents formally constituted were the first problem detected. A second issue was the proliferation of new agents in the recent governments, even without legal commandment, implementing divergent policies. As incentive model affects efficiency of the regulatory system, observed instability might be one of the key factors for the low performance of regulatory activities, permitting natural market failures to be more noticeable.

    As emerging economies experience a boom in capital inflows after the global financial crisis, governments were increasingly concerned about the downsides of these inflows. Even the IMF (International Monetary Fund), long a stalwart proponent of financial liberalization, has engaged in a new debate on capital flow management. Drawing lessons from empirical case studies on Brazil and South Korea, this paper finds that the new IMF framework remains insufficient in two main aspects. First, by defining "capital flow management measures" (CFMs) as a temporary instrument embedded in an overall strategy of financial opening, the organization insists in the general advantages of financial liberalization, which poses serious limits to emerging economies' policy space. Second, the Fund insists in in a separation of prudential financial regulation, which should be permanent, and only temporary CFMs. Yet, the case studies of Brazil and Korea presented in this paper show that especially for emerging markets with rather diversified domestic financial markets, both types of measures are interdependent and overlapping. Additionally, we demonstrate in our case studies the relevance of a third type of regulation, lying on foreign exchange (FX) derivatives instruments, which may also be required to effectively manage foreign investors' portfolio reallocations and their impact.
