Engaging with key texts of the romantic period, the book outlines a wide-reaching project to re-imagine the middle as a constitutive principle. Sng argues that Romanticism dislodges such terms as medium, moderation, and mediation from serving as mere self-evident tools that conduct from one pole to another. Instead, they offer a dwelling in and with the middle: an attention to intervals, interstices, and gaps that make these terms central to modern understandings of relation

    This volume exposes the contested history of a virtue so central to modern disciplines and public discourse that it can seem universal. The essays gathered here, however, demonstrate the emergence of impartiality. From the early seventeenth century, the new epithet 'impartial' appears prominently in a wide range of publications. Contributors trace impartiality in various fields: from news publications and polemical pamphlets to moral philosophy and historical dictionaries, from poetry and drama to natural history, in a broad European context and against the backdrop of religious and civil conflicts. Cumulatively, the volume suggests that the emergence of impartiality is implicated in the period's epochal shifts in epistemology and science, religious and political discourse, print culture, and scholarship.     Crime, violence, and insecurity are perceived as society's biggest problems in contemporary Costa Rica. This degree of priority is especially remarkable because the country has always been considered the peaceful exception in the violent Central American region. In this paper I analyze four cornerstones of the nonviolent national self-perception in the 1940s and 1980s as the fundamental basis for the current talk of crime: the civil war, the abolition of the military, the proclamation of neutrality, and the peace plan for Central America and the subsequent granting of the Nobel Peace Prize. The result of the analysis is the determination that these historical cornerstones were not publicly discussed as expressions of the nonviolent identity for which they are today cited as evidence. -- Costa Rica ; violence ; crime ; social order ; national identity ; public discourse Gewalt und Kriminalität werden in der costaricanischen Öffentlichkeit heute als die größte gesellschaftliche Bedrohung wahrgenommen. Diese Prioritätensetzung ist nicht zuletzt deshalb bemerkenswert, weil Costa Rica seit langem als die friedvolle Ausnahme in der gewalttätigen zentralamerikanischen Region gilt. Dieser Beitrag untersucht vier Säulen der gewaltlosen Selbstwahrnehmung in den 1940er und 1980er Jahren: den Bürgerkrieg, die Abschaffung des Militärs, die Neutralitätserklärung und den Friedensplan für Zentralamerika, für den Oscar Arias mit dem Friedensnobelpreis ausgezeichnet wurde. Der Beitrag zeigt, dass diese historischen Momente in den 1940er und 1980er Jahren öffentlich nicht unter dem Gesichtspunkt von Gewaltlosigkeit debattiert und wahrgenommen wurden und dass sich die damaligen Debatten nicht mit ihrer heutigen Interpretation als Belege einer gewaltlosen nationalen Identität decken.

    Especially in mediation as an out-of-court conflict mediation procedure, maintaining the basic attitude on the part of a neutral, third party is a core aspect and at the same time a neuralgic point. The ability to maintain impartiality and neutrality as anideal in a mediation role is central and determines success and failure. Often in conflicts there are a number of people-based problems that focus on mediators as individuals. Thus, phenomena of assessment can emerge, with unconscious bias on the part of conflict parties who experience disadvantage and prejudice. This can be associated with a gender-specific or gender-sensitive component. The question of the extent to which the mediator can be socially supported in conflict management through social human-machine interaction with artificial intelligence (AI) and human-machine collaboration (HMC) is a novelty. There is also the question of whether problems with impartiality and neutrality can be solved by gender-neutral robots as assistance with social human-machine interaction. The innovation of learning systems needs acceptance despite murmuring criticism of it. Insights from AI studies show that AI will revolutionizethe way people decide, work, learn, communicate, consume and live. This is no longer a science fiction dream.The Future is Now!

    1. Die gesetzliche Regelung des § 2 VerfArt29G BE 2005 (sog. Berliner Neutralitätsgesetz), die das Tragen eines islamischen Kopftuchs durch eine Lehrkraft im Dienst einer öffentlichen bekenntnisoffenen Bekenntnisschule ohne Weiteres verbietet, greift in das Recht der Religionsfreiheit nach Art. 4 GG ein. 2. Das Berliner Neutralitätsgesetz ist verfassungskonform dahingehend auszulegen, dass ein Kopftuchverbot für Lehrerinnen eine wesentliche und entscheidende berufliche Anforderung i.S.v. § 8 AGG nur dann darstellt, wenn eine hinreichend konkrete Gefahr für die staatliche Neutralität oder den Schulfrieden besteht. 3. Wird eine Lehrerin allein deshalb nicht eingestellt, weil Sie sich weigert, ihr Kopftuch während des Unterrichts abzulegen, ohne dass konkrete Anhaltspunkte dafür vorliegen, dass im Einzelfall das Tragen des Kopftuchs die schulischen Abläufe und die Erfüllung des staatlichen Erziehungsauftrags ernsthaft beeinträchtigt, liegt eine Benachteiligung gem. § 7 AGG aufgrund der Religion vor. Dies führt zu einer Entschädigungspflicht des Landes.

    Crime, violence, and insecurity are perceived as society's biggest problems in contemporary Costa Rica. This degree of priority is especially remarkable because the country has always been considered the peaceful exception in the violent Central American region. In this paper I analyze four cornerstones of the nonviolent national self-perception in the 1940s and 1980s as the fundamental basis for the current talk of crime: the civil war, the abolition of the military, the proclamation of neutrality, and the peace plan for Central America and the subsequent granting of the Nobel Peace Prize. The result of the analysis is the determination that these historical cornerstones were not publicly discussed as expressions of the nonviolent identity for which they are today cited as evidence. -- Costa Rica ; violence ; crime ; social order ; national identity ; public discourse Gewalt und Kriminalität werden in der costaricanischen Öffentlichkeit heute als die größte gesellschaftliche Bedrohung wahrgenommen. Diese Prioritätensetzung ist nicht zuletzt deshalb bemerkenswert, weil Costa Rica seit langem als die friedvolle Ausnahme in der gewalttätigen zentralamerikanischen Region gilt. Dieser Beitrag untersucht vier Säulen der gewaltlosen Selbstwahrnehmung in den 1940er und 1980er Jahren: den Bürgerkrieg, die Abschaffung des Militärs, die Neutralitätserklärung und den Friedensplan für Zentralamerika, für den Oscar Arias mit dem Friedensnobelpreis ausgezeichnet wurde. Der Beitrag zeigt, dass diese historischen Momente in den 1940er und 1980er Jahren öffentlich nicht unter dem Gesichtspunkt von Gewaltlosigkeit debattiert und wahrgenommen wurden und dass sich die damaligen Debatten nicht mit ihrer heutigen Interpretation als Belege einer gewaltlosen nationalen Identität decken.

Zur Bewältigung dieses Spannungsverhältnisses zwischen Theorie und Praxis geht Hui-chieh Su vertiefend auf die Konstellation der Meinungsfreiheit in der gesamten Verfassungsordnung ein. -- Die Autorin nimmt das Verbot fiktiver Darstellungen, welche sich als »opferlos« verstehen, zum Forschungsgegenstand. Sie führt die Rechtfertigung des betreffenden Verbots, insbes. die Auslegung des Prinzips der Meinungsneutralität des Staates, auf den Begriff des »Harms« auf politisch-philosophischer, verfassungsrechtlicher, grundrechtlicher und meinungsfreiheitlicher Ebene zurück. -- Su gelangt zum Ergebnis, dass unterschiedliche Vorstellungen über Menschenbild und Menschenwürde unterschiedliche Konzeptionen von »Harm« und »Meinungsneutralität des Staates« zur Folge haben. Dem entspricht auch ihre ausführliche Analyse der Meinungsfreiheitsdogmatik in Deutschland und den USA
