    The recent process of political and economic transformation in eastern European countries has not only contributed to the decentralisation of political structure but also significantly enhanced the fiscal autonomy of municipalities belonging to these countries. Although the degree of self-governing ability of municipalities seems to vary from one country to another, many similar types of public activities have recently been assigned to local governments, and some taxes were also declared to be so-called local taxes. To be sure, this type of fiscal decentralisation has caused some additional problems, particularly for safeguarding the quality of publicly provided goods and services and for coordinating intergovernmental fiscal transfers between the central and local governments in an efficient way. For instance, some criticise that a large number of small-sized municipalities in the transition economies have suffered from financial bottleneck and have not been able to receive financial support from the central government that was necessary for their economic development. However, such a fiscal devolution trend appears to continue, in parallel to the ongoing democratisation and decentralisation. This study primarily deals with crucial issues surrounding the impact of national fiscal policy and the regulatory framework on local governments' expenditure behaviour and their ability to mobilise necessary revenues (i.e. tax income, grants and municipal borrowings) under the particular consideration of the institutional and administrative cooperation with the central government and of the (still existing) lesswell developed financial market in Poland, the Slovak Republic, the Czech Republic and Hungary.

    Abstract: "Europäische Studien der vergangenen Jahrzehnte haben sich hauptsächlich mit den Auswirkungen des europäischen Integrationsprozesses auf den Föderalismus in Deutschland und insbesondere den damit verbundenen neuen Herausforderungen für die deutschen Länder beschäftigt. Die Rolle der Kommunen ist dabei oft unberücksichtigt geblieben. Doch gerade europäische Bestimmungen grenzen häufig genug gemeindliche Selbstverwaltungsrechte durch die Tiefe und Dichte ihrer Regelungen ein. So obliegt die Umsetzung eines Großteils der europäischen Vorgaben den Kommunen, ohne dass diese an der Entscheidungsfindung auf der europäischen Ebene umfassend beteiligt wären. Und auch die innerstaatliche Mitsprache in europäischen Angelegenheiten wird oftmals vom Bund und den deutschen Ländern blockiert. Auch gibt es für die deutschen lokalen Gebietskörperschaften bislang kaum Möglichkeiten, gegen die Auferlegung von Pflichten durch europäische Bestimmungen zu klagen.     Im Zusammenhang mit der anstehenden Gemeindefinanzreform erneuert das Institut seine Forderung nach Abschaffung der Gewerbesteuer. Als Ersatz wird die Anhebung des Gemeindeanteils an der Umsatzsteuer und die Einführung des kommunalen Hebesatzrechts bei Einkommen- und Körperschaftsteuer vorgeschlagen. Die Studie stellt zunächst die verfassungsrechtlichen Anforderungen an eine derart umfassende Reform zusammen; insbesondere wird untersucht, welche Bedeutung der kommunalen Steuerautonomie dabei zukommt. Der folgende Abschnitt benennt und begründet die steuer- und finanzpolitischen Anforderungen an den Ersatz der Gewerbesteuer. Anschließend werden die steuer- und finanzpolitischen Mängel und Gefahren der Gewerbesteuer festgestellt sowie die verfassungsrechtlichen Bedenken aufgezeigt, die gegen die Gewerbesteuer selbst und gegen die Anrechnungsregelung bestehen. Schließlich erläutert die Studie den eigenen Vorschlag für den Gewerbesteuerersatz und setzt sich mit anderen Ersatzvorschlägen auseinander. Kernstück der Studie ist der eigene Vorschlag zum Abbau und zum Ersatz der Gewerbesteuer. Eingehend wird dargelegt, dass dieser den steuer- und finanzpolitischen Anforderungen entspricht und den verfassungsrechtlichen Vorgaben Rechnung trägt. Insbesondere wird nachgewiesen, dass das finanzielle Gleichgewicht im Bundesstaat gewahrt und der Anspruch der Gemeinden auf eine wirtschaftskraftbezogene Steuerquelle mit Hebesatzrecht erfüllt wird. Der Verteilung des Umsatzsteueranteils auf die einzelnen Gemeinden und der Gestaltung des Hebesatzrechts bei der Einkommensteuer sind eigene Abschnitte gewidmet.     The recent process of political and economic transformation in eastern European countries has not only contributed to the decentralisation of political structure but also significantly enhanced the fiscal autonomy of municipalities belonging to these countries. Although the degree of self-governing ability of municipalities seems to vary from one country to another, many similar types of public activities have recently been assigned to local governments, and some taxes were also declared to be so-called local taxes. To be sure, this type of fiscal decentralisation has caused some additional problems, particularly for safeguarding the quality of publicly provided goods and services and for coordinating intergovernmental fiscal transfers between the central and local governments in an efficient way. For instance, some criticise that a large number of small-sized municipalities in the transition economies have suffered from financial bottleneck and have not been able to receive financial support from the central government that was necessary for their economic development. However, such a fiscal devolution trend appears to continue, in parallel to the ongoing democratisation and decentralisation. This study primarily deals with crucial issues surrounding the impact of national fiscal policy and the regulatory framework on local governments' expenditure behaviour and their ability to mobilise necessary revenues (i.e. tax income, grants and municipal borrowings) under the particular consideration of the institutional and administrative cooperation with the central government and of the (still existing) lesswell developed financial market in Poland, the Slovak Republic, the Czech Republic and Hungary.
