    This paper estimates how beer franchise laws and their interaction with restrictions on vertical integration between manufacturing and wholesaling impacted US craft brewers' entry and production decisions. The effects are identified by exploiting variation in policies across states and time between 1980 and 2016. I find that beer franchise laws significantly reduced craft brewery entry and growth, leading to lower levels of breweries and craft beer production. The effects are largest in states that place restrictions on brewery/wholesaler integration. The findings in this paper indicate that contract termination restrictions, which were legislated to protect wholesalers from upstream brewers, had the effect of encouraging opportunism from wholesalers and inhibited the growth of smaller firms in the industry.

    We decompose the difference between a firm's market value and book value into two components: reproducible intangible assets that can be created by competing firms through SG&A/R&D expenditures, and the residual denoted as franchise value which includes the value of transient-rents from capacity-adjustment-costs (Tobin's Q), longer-lasting franchise rents, and potential market-price intrinsic-value differences. We estimate the parameters of the model for building reproducible intangible capital using 176,005 firm-years of data for nonfinancial firms that are in COMPUSTAT and CRSP databases during the period 1976-2020. The estimated depreciation rates for intangible assets created by capitalizing R&D and SG&A expenditures respectively, and the portion of SG&A that contributes to organizational capital, while consistent with the parameters used in the empirical literature, vary significantly across industries. Ceteris paribus, firms with higher franchise values face fewer product market threats and have higher markups, whereas firms with higher reproducible intangible assets face higher threats. Higher franchise value reduces the sensitivity of a firm's investments with respect to total Tobin Q. Firms facing fewer product market threats, a measure of competitive advantage, experienced a larger increase in their franchise values due to increased globalization following China's entry into WTO in 2002 which is consistent with theory

    The paper investigates survival patterns of Brazilian franchising firms during the 1994-1999 period. First, at a more descriptive level one considered the (percentage) survival of newly created franchisors in the following years. The evidence indicated a drastic decay in survival after only a few years and contrasts with the higher survival of firms in the franchising firms in more developed economies. Survival functions were obtained by means of the Kaplan-Meier estimator for the selected sectors and indicated sharp declines in survival rates over time but with differential patterns across sectors. Finally, an econometric analysis based on Cox's proportional hazard model was considered by exploring explanatory variables pertaining size, age and support regarding legal aspects, location choice and training. The evidence indicates that those supports provided by the franchisor have a positive impact on the probability of survival of new firms whereas there is partial evidence favoring a positive role for firm size on survival. -- franchising ; survival

    Die Neue Institutionenökonomik unterscheidet zwischen generellem (d.h. leicht weiterzugebendem) und spezifischem (d.h. schwer übertragbarem) Wissen. Die Industriewirtschaft beruhte weitgehend auf generellem Wissen. Die Unternehmensspitze hatte die beste Übersicht, was zu tiefgestaffelten Unternehmenshierarchien führte. Demgegenüber basiert die postindustrielle Wirtschaft in hohem Maße auf spezifischem Wissen. Insoweit hat die Basis den besseren Durchblick, weshalb ihr erhebliche Entscheidungskompetenzen zufallen. Genossenschaften sind wie das Franchising postindustrielle Strukturen. Beides sind hybride Organisationsformen, bei denen die Einheiten an der Basis selbständig agieren. Beide stützen sich außerdem auf hierarchische Klammern. Diese gehen bei den Genossenschaften von unten nach oben, während es sich beim Franchising umgekehrt verhält. Der Grund dafür ist, daß die Identität einer lokalen Genossenschaft in sich selbst ruht und die Verbundunternehmen eher die Rolle von Zulieferern haben. Demgegenüber beziehen Franchisenehmer ihre Identität aus ihrer Verbindung zum Franchisegeber. Beide Strukturen sind daher trotz vieler Gemeinsamkeiten fundamental verschieden.

    In this paper we investigate an example of a very widely applied model for the delivery of IT services to rural and poor populations. The model is one where limited intervention to support infrastructure and coordinate resources is combined with marketbased delivery of IT services to the end user (what we call here the sustainable franchise modelʺ). Though this model has been deployed world-wide by governments, NGOs, and development institutions in the past few years, there has been little research into the determinants of success in such a model. In this paper we examine the example of n-Logue, a franchise of over 1000 locally-owned, Internet kiosks in rural villages in India. We seek to assess how this new sustainable franchise model has worked in practice by analyzing data from 74 of n-Logue's kiosks. Among other things, we find that gender and education do not affect success, while location and other measures of social standing (age and caste) do. We also find that the uses that villagers have for IT services are not so different from those which first world users have. The lessons we draw from this example are that while local customs and practices must be taken into account (e.g. the caste system), it is not a foregone conclusion that social biases (e.g. against women) cannot be mitigated by good program design.
