    For years, businesses have complained about the costs of regulatory compliance. On the other hand, society is becoming increasingly aware of the environmental, safety, health, financial, and other risks of business activity. Government oversight seems to be one of the answers to safeguard against these risks. But how can we deregulate and regulate without jeopardizing our public goals or acting as a brake on economic growth? Many instruments are available to assess the effects of laws regulating business, including the regulatory impact assessment (RIA), which contains cost/benefit analysis, cost-effectiveness analysis, risk analysis, and cost assessments. This book argues that public goals will be achieved more effectively if compliance costs of the enterprises are as low as possible. Highlighting examples from a wide spectrum of industries and countries, the authors propose a new kind of RIA, the business impact assessment (BIA), designed to improve both business and public policy decision making.

    This paper explores the short-term employment effect of deregulating job protection for regular workers and how it varies with prevailing business cycle conditions. We apply a local projection method to a newly constructed 'narrative' dataset of major regular job protection reforms covering 26 advanced economies over the past four decades. The analysis relies on country-sector-level data, using as an identifying assumption the fact that stringent dismissal regulations are more binding in sectors that are characterized by a higher 'natural' propensity to regularly adjust their workforce. We find that the responses of sectoral employment to large job protection deregulation shocks depend crucially on the state of the economy at the time of reform--they are positive in an expansion, but become negative in a recession. These findings are consistent with theory, and are robust to a broad range of robustness checks including an Instrumental Variable approach using political economy drivers of reforms as instruments. Our results provide a case for undertaking job protection reform in good times, or for designing it in ways that enhance its short-term impact

    The model of power sector reform that emerged during the 1990s placed considerable emphasis on the creation of an independent regulatory agency, with a strong orientation toward technically-driven tariff-setting procedures. Despite widespread uptake of regulation, implementation has proved to be challenging in the developing world. Regulators were seldom as independent as originally envisaged, with widespread divergence between the formal regulatory framework and the day-to-day practice of regulation. In practice, many developing countries operate with "advisory regulators" whose main role is to provide technical support to the ultimate political decision makers. Nevertheless, there is some evidence that regulation has had a positive performance impact, particularly where utilities are privatized and in middle-income settings. But the impact is more questionable in cases where regulation is primarily directed toward state-owned enterprises, which lack the commercial incentives to respond to regulatory instruments. On the choice of regulatory regimes, the ongoing debate between price cap and rate of return regulation suggests that the latter may be better suited to developing country environments where the priority is to provide predictable returns to support large capital investment programs. Furthermore, the advent of technological disruption in the power sector demands an adaptation of the way in which regulatory instruments are designed and applied. Regulators will need to pay closer attention to providing the right incentives for utilities to innovate and become more energy efficient, and for consumers to take economically grounded decisions on distributed generation. Finally, the literature leaves many important questions unanswered, such as how regulatory design affects regulatory effectiveness and the impact of tariff regulation on cost recovery

    This paper describes a new database of major labor and product market reforms covering 26 advanced economies over the period 1970-2013. The focus is on large changes in product market regulation in seven individual network industries, employment protection legislation for regular and temporary workers, and the replacement rate and duration of unemployment benefits. The main advantage of this dataset is the precise identification of the nature and date of major reforms, which is valuable in many empirical applications. By contrast, the dataset does not attempt to measure and compare policy settings across countries, and as such is no substitute for other publicly available indicators produced, for example, by the ILO, the OECD or the World Bank. It should also be seen as work in progress, for researchers to build on and improve upon. Based on the dataset, major reforms appear to have been more frequent in product markets than in labor markets in the last decades, and were predominantly implemented during the 1990s and 2000s

    Despite the scepticism raised by the German Monopoly Commission our analysis shows that the revised theory of contestable markets can be applied to the telecommunications market better than expected. The original contestable market theory implied three assumptions necessary to be satisfied to establish potential competition: Free market entry, market exits possible without any costs, and the price adjustment lag exceeds the entry lag. Our analysis shows that if the incumbent reduces its prices slowly (high adjustment lag) and the market entry can be performed quickly (low entry lag), a new competitor will be able to earn back sunk costs ...
