Anonymous Speech, the Secret Ballot and Campaign Contributions Anonymous Speech: Literature, Law and Politics discusses the different contexts in which people write anonymously or with the use of a pseudonym: novels and literary reviews, newspapers and political periodicals, graffiti, and now on the Internet. The book criticises the arguments made for a strong constitutional right to anonymous speech, though it agrees that there is a good case for anonymity in some circumstances, notably for whistle-blowing. One chapter examines the general treatment of anonymous speech and writing in English law, while another is devoted to the protection of journalists' sources, where the law upholds a freedom to communicate anonymously through the media. A separate chapter looks at anonymous Internet communication, particularly on social media, and analyses the difficulties faced by the victims of threats and defamatory allegations on the Net when the speaker has used a pseudonym. In its final chapter the book compares the universally accepted argument for the secret ballot with the more controversial case for anonymous speech. This is the first comprehensive study of anonymous speech to examine critically the arguments for and against anonymity. These arguments were vigorously canvassed in the nineteenth century - largely in the context of literary reviewing - and are now of enormous importance for communication on the Internet

Car au Moyen Âge, l'anonymat de l'auteur et de l'oeuvre est un fait massif des arts et de la littérature. De fait, le nom de l'auteur est bien souvent absent des oeuvres médiévales: point de signature, encore moins de figure pour incarner l'auctorialité des textes, des tableaux, des compositions musicales ou des édifices... Pour autant, l'anonymat n'est pas un vide, mais plutôt un creux où vient se lover une intention particulière. Il n'est pas une forme absente, mais un effet qui contribue à construire l'identité et la signification des oeuvres. On pourrait même dire qu'il n'y a pas un, mais des anonymats, qui dessinent, dans la lecture que l'on peut faire de la création médiévale, autant de lignes de force différentes, et qui remplissent des fonctions variées. C'est cette diversité que reflètent les dix-huit contributions de ce volume dont l'ambition est de faire la démonstration que, loin d'être un simple accident de l'oeuvre, l'anonymat est un fait de création qui met en jeu son interprétation."--Page 4 of cover

    "L'homme et l'oeuvre... Il fut un temps où la critique éclairait et expliquait l'un par l'autre. Temps révolu, certes, pour les études littéraires, et que les modes de la création médiévale auraient de toute façon voué à l'échec. Car au Moyen Âge, l'anonymat de l'auteur et de l'oeuvre est un fait massif des arts et de la littérature. De fait, le nom de l'auteur est bien souvent absent des oeuvres médiévales: point de signature, encore moins de figure pour incarner l'auctorialité des textes, des tableaux, des compositions musicales ou des édifices... Pour autant, l'anonymat n'est pas un vide, mais plutôt un creux où vient se lover une intention particulière. Il n'est pas une forme absente, mais un effet qui contribue à construire l'identité et la signification des oeuvres. On pourrait même dire qu'il n'y a pas un, mais des anonymats, qui dessinent, dans la lecture que l'on peut faire de la création médiévale, autant de lignes de force différentes, et qui remplissent des fonctions variées. C'est cette diversité que reflètent les dix-huit contributions de ce volume dont l'ambition est de faire la démonstration que, loin d'être un simple accident de l'oeuvre, l'anonymat est un fait de création qui met en jeu son interprétation."--Page 4 of cover
