    ger: In dieser Dissertation wird die Stellung des Rechtssubjekts in paradigmatischen theologischen Konzepten der Rechtsethik evangelischer und katholischer Prägung der vergangenen zwanzig Jahre untersucht und verglichen. Gemeinsam ist den Ansätzen der Versuch, eine Rechtsethik zu entwerfen, die mit der Pluralität moralischer Überzeugungen innerhalb eines weltanschaulich neutralen Staates sensibel umgeht. Konfessionelle Unterschiede finden sich insbesondere in der Rechtsbegründung. Während katholische Ansätze naturrechtlich geprägt sind, stehen evangelische Konzepte dem Rechtspositivismus nahe. Die Zwei-Reiche-Lehre Martin Luthers und die reformatorische Rechtfertigungslehre bilden dafür den theologischen Hintergrund. Leitend ist in dieser Untersuchung eine individualethische Perspektive. Auch hier ist ein konfessioneller Unterschied festzustellen. Evangelische Autoren betrachten das Subjekt nämlich vorwiegend als Rechtsunterworfenen. Sie gehen daher von der Pflicht zur Loyalität dem Recht gegenüber aus und fragen gegebenenfalls nach den Voraussetzungen legitimen Widerstands. Katholische Autoren suchen hingegen nach den Voraussetzungen für die richtige Gestaltung des Rechts durch das Subjekt und stellen sowohl implizit als auch explizit dessen Mitverantwortung für die Rechtsentwicklung in den Mittelpunkt. Mit den beiden konfessionell bedingten Schwerpunkten ist jedoch nicht notwendigerweise die Formulierung eines Gegensatzes verbunden. Vielmehr sind alle angeführten Verhaltensweisen (Loyalität, Mitverantwortung, Widerstand) für eine Rechtsethik aus individualethischer Sicht bedeutsam. Daher wird die These formuliert, dass es auch innerhalb der Rechtsethik einen differenzierten Konsens geben kann. Damit wird die im Zusammenhang mit der Gemeinsamen Erklärung zur Rechtfertigungslehre 1999 entstandene Figur ökumenischer Verständigung weitergeführt. eng: This doctoral thesis examines and compares the positions of legal subjects in paradigmatic protestant and catholic theological concepts of legal ethics of the last twenty years. All of the approaches have in common that they try to outline a system of legal ethics which treats the plurality of ethical convictions within an ideologically neutral state sensitively. Denominational differences can be particularly found concerning legal foundation. The catholic approaches are informed by jusnaturalistic thinking, whereas protestant approaches are close to legal positivism, Martin Luther’s two kingdoms doctrine and the protestant doctrine of justification being the theological background. The guiding perspective in this analysis is one of individual ethics, leading to another denominational difference. For the protestant authors, a legal subject is primarily subjected to law. They tend to see each subject obliged to be faithful to the law and ask, if necessary, for the prerequisites of legitimate resistance. Catholic authors, on the other hand, ask for the prerequisites for the proper shaping of the law by the subject and therefore emphasize the subject's responsibility for legal development both implicitly and explicitly. These two differences, which are based on different denominational focuses, do not necessarily make the concepts contradictory. Rather, all the discussed behaviors (loyalty, shared responsibility, resistance) are significant from the individual's perspective of legal ethics. This leads me to formulating the proposition that a differentiated consensus within legal ethics is possible, which is a continuation of ecumenical convergence as designed in context with the Joint Declaration concerning the Doctrine of Justification in 1999.

    In The Philosophy of the Limit Drucilla Cornell examines the relationship of deconstruction to questions of ethics, justice, and legal interpretation. She argues that renaming deconstruction "the philosophy of the limit" will allow us to be more precise about what deconstruction actually is philosophically and hence to articulate more clearly its significance for law. Cornell explores the ethical and juridical significance of the so-called postmodern rebellion against metaphysics. A shared ethical rebellion links philosophers as different as Theodor Adorno, Jacques Derrida, Jacques Lacan, and Emmanuel Levinas. Together they present a new ethical configuration, new in its difference from both the critical social theory of Jurgen Habermas and the analytic jurisprudence of Nagel and Rawls. A key aspect of this newness is the centrality given to the relationship between questions of ethics and sexual difference Cornell argues that the appeal of Lacan's analysis to feminists is that it helps to explain the profound hold the gender hierarchy has over Western culture, including its theories of political transformation. Cornell examines Derrida's position on the significance of the gender hierarchy in philosophy and explores its ethical and political importance. Derrida's intervention against legal positivism has important implications for the legal reforms necessary to protect marginalized groups. His emphasis on the limit, she argues, is crucial to those whose well-being and very lives may depend on legal transformation, women and homosexuals, for example. Cornell's focus on the importance of the limit and the centrality of the gender hierarchy allows her to offer a view of jurisprudence different from both critical social theory and analytic jurisprudence In 1992, as we watch the long-fought-for civil rights of women systematically overturned, we have reason to think about how the connections she makes shed light on an underlying truth of our social, political, and legal reality

    Welche Rolle spielt die Hermeneutik in der Ethik und welche die Ethik in Hermeneutik und Interpretationstheorie?Die Beiträge des vorliegenden Bandes analysieren nicht nur die komplexen Verbindungen von Ethik und Hermeneutik auf dem Gebiet der allgemeinen Hermeneutik, sondern diskutieren auch Fragen verschiedener Bereichsethiken. Zur Diskussion steht das Verhältnis von Wahrnehmung und Urteil, deskriptiv-hermeneutischem und normativem Zugang zu ethischen Fragen. Gleichzeitig ist aber auch das Ethos der Hermeneutik eine Kardinalfrage hermeneutischer Theoriebildung in Geschichte und Gegenwart, weil alles Verstehenkönnen auch vom Verstehenwollen abhängt und somit nicht nur eine Frage philologischer oder sonstiger Kompetenzen der Interpretation ist, sondern eben auch eine Frage der Ethik
