    The recent process of political and economic transformation in eastern European countries has not only contributed to the decentralisation of political structure but also significantly enhanced the fiscal autonomy of municipalities belonging to these countries. Although the degree of self-governing ability of municipalities seems to vary from one country to another, many similar types of public activities have recently been assigned to local governments, and some taxes were also declared to be so-called local taxes. To be sure, this type of fiscal decentralisation has caused some additional problems, particularly for safeguarding the quality of publicly provided goods and services and for coordinating intergovernmental fiscal transfers between the central and local governments in an efficient way. For instance, some criticise that a large number of small-sized municipalities in the transition economies have suffered from financial bottleneck and have not been able to receive financial support from the central government that was necessary for their economic development. However, such a fiscal devolution trend appears to continue, in parallel to the ongoing democratisation and decentralisation. This study primarily deals with crucial issues surrounding the impact of national fiscal policy and the regulatory framework on local governments' expenditure behaviour and their ability to mobilise necessary revenues (i.e. tax income, grants and municipal borrowings) under the particular consideration of the institutional and administrative cooperation with the central government and of the (still existing) lesswell developed financial market in Poland, the Slovak Republic, the Czech Republic and Hungary.

    In the context of EMU fiscal equalization schemes have been proposed as a means to stabilize regions against asymmetric shocks. A theoretical analysis shows that besides reducing the cross-sectional income variance the redistributive element of fiscal equalization causes incentive effects for regional governments, undermining the efficient supply of public goods. Yet, this objection is shown to be less important in a situation of insufficient demand, where interregional redistribution actually favors stabilization. In an empirical analysis for Germany, the paper adds support for the finding of significant regional stabilization by fiscal flows. The results indicate that about 17 % of GDP variation across West Germany's states has been removed by fiscal flows during the last two decades. Thus, in Germany where the fiscal federalism is criticised for its heavy equalization the extent of regional stabilization provided by fiscal flows is quite similar to other federal countries.

    The planned movement to the origin priciple with the cross-border pre-tax system on a full-scale would lead, ceteris paribus, to changes in VAT revenues in the individual EU countries. For instance, the member countries with trade surpluses and higher VAT rates would be significantly better off. For this reason, a clearing mechanism is necessary to rectify this type of revenue inbalance among the EU nations. The introduction of the Single Market in 1993 appears to have further encouraged firms`and households`evasive behaviour in paying VAT in the EU. In order to estimate its relevance, this study quantifies the annual amount of hypothetical VAT revenues for the individual countries on the basis of the national accounts data. The relation between the calculated hypothtical and the (current) collected revenues in a fiscal year largely determines the extent of VAT evasion of a country when the time-lag problem between the creation of tax liability and the VAT collection in cash terms can be adjusted. The macroeconomic clearing is supposed to take place based on the share of hypothetical revenues of the member countries. Consequently, such a system seriously suffers from the adverse incentives for the individual nations since countries with a lower evasion ratio than the weighted average of all EU countries would lose the VAT revenues, whereas those with a higher evasion ratio would gain.

    The paper describes the content of the project Tax-/Transfer-Reform and Fiscal Responsibility: Pathways to a Sustainable Fiscal Policy in Georgiaʺ, which is supported for the period Fall 2005 to Spring 2008 by the VolkswagenStiftung. Within the project a knowledgetransfer is organized, concentrating on state theory, tax and transfer reform, revenue sharing as well as fiscal equalization. A short overview on the current situation in Georgia is presented. Then the main project components tax reform, tax revenue estimation and microsimulation are briefly discussed.

    Under the influence of orientation towards European integration, Georgia has introduced a variety of new laws with the apparent aim to decentralize legislative and executive powers. This paper shows that the Georgian efforts of decentralization remain superficial, mainly because they are not backed by additional fiscal competences at the municipality level. Following an initial description of the pre-reform situation as of 2006 and based upon a detailed account of the structural changes since 2007, the author gives insight into the conflicts which arise from the lack of institutional congruency. Neither the extraordinary status of the capital Tbilisi nor the seeming autonomy of the Rebublic of Adjara are likely to sway the renegade territories of Abchasia and Ossetia towards a reintegration under Georgian centralized rule as it continues to exist today. Likewise, the success of the proposed and discussed fiscal equalization scheme depends on whether the President and his ruling party are willing to delegate powers to the subodinate jurisdictions.

    Mit der vorliegenden staatsrechtlichen Studie unterbreitet Joachim Sanden einen Vorschlag für die Neugestaltung des Strukturgefüges zwischen Bund und Ländern. Ausgehend von der Schaffung leistungsfähiger Bundesländer im Wege der Neugliederung des Bundesgebietes, sind eigenständige kompetenzielle und finanzielle Verantwortungsbereiche für die Länder zu schaffen sowie prozedurale und institutionelle Verbesserungen des föderalen Miteinanders zu finden. Angestrebt wird eine Strukturoptimierung in den Bereichen Gebiet, Kompetenzen, Finanzen und Prozedere.Nach einer umfangreichen Schwachstellenanalyse formuliert Sanden ein postmodernes Paradigma der weiteren Entwicklung der Bundesrepublik. Auf dieser Basis unterbreitet er Vorschläge für die Neugliederung des Bundesgebiets sowie für die Kompetenzordnung und die Finanzbeziehungen. Ferner stehen die Reformkonsequenzen für die bundesstaatlichen Verfahren und Institutionen im Mittelpunkt. Schließlich prüft Sanden die Vereinbarkeit des poststrukturellen Vorschlags mit der grundgesetzlichen Ordnung
