    Hauptbeschreibung Andreas Jens versucht dem Problem, dass viele Anwender nationalen Strafrechts dem Europäischen Gemeinschaftsrecht mit zurückhaltender Skepsis begegnen, durch eine Systematisierung zu begegnen. Strafrecht bedürfe keiner Sonderbehandlung unter dem Gemeinschaftsrecht. Vielmehr führe eine genaue Definition der widerstreitenden Normen, insbesondere der Grundfreiheiten, die der Verfasser auf ihren gleichheitsrechtlichen Gehalt begrenzt, sowie die Beachtung der rechtsstaatlichen Garantien des Gemeinschaftsrechts dazu, dass die gemeinschaftsrechtlichen Vorgaben, der Anwendungsvorrang und die gemeinschaftsrechtskonforme Auslegung im Strafrecht unverändert gelten könnten. Rechtsstaatliche Schreckensszenarien seien unbegründet, obgleich das Gemeinschaftsrecht - zum Teil als Obergrenze, zum Teil als verpflichtendes Mindesterfordernis - sowohl auf die Voraussetzungs- als auch auf die Sanktionsseite der nationalen Strafnormen einwirke.   Inhaltsverzeichnis Inhaltsübersicht: Einführung - 1.
