    Seit Ausbruch der weltweiten Finanz- und Wirtschaftskrise 2007 findet in der Politik, den Medien und der Ökonomik eine breite Debatte zur Rolle und Regulierung der Ratingagenturen statt. Der vorliegende Artikel fokussiert explizit nur auf einen Aspekt dieser Debatte, nämlich die Rolle und Regulierung der Ratingagenturen im Rahmen ihrer Bewertung strukturierter Finanzprodukte. Anhand einer spieltheoretischen Modellierung wird gezeigt, dass sich die Interaktion von Ratingagenturen und Emittenten strukturierter Finanzprodukte im Zuge der Entwicklung und Bewertung strukturierter Finanzprodukte als ein klassisches Gefangenendilemma rekonstruieren lässt. In diesem geben die Ratingagenturen bewusst nicht-risikoadäquate Ratings ab, während die Emittenten bewusst unzureichende Prozessstandards bei der Produktentwicklung anwenden. Zur Überwindung dieses Dilemmas wird eine synchron erfolgende Regulierung der Ratingagenturen und der Emittenten vorgeschlagen, wodurch eine Besserstellung sowohl der Ratingagenturen als auch der Emittenten unter gleichzeitiger Erreichung des gesellschaftlich erwünschten Zustandes möglich wird. Davon ausgehend identifiziert die Arbeit drei Stellhebel für eine zielführende Regulierung der Ratingagenturen im Rahmen ihrer Bewertung strukturierter Finanzprodukte: (a) Verringerung bzw. Vermeidung des so genannten ratings shopping; (b) Reduzierung der Anzahl der Ratingagenturen - ggf. gar die Etablierung einer Monopollösung; (c) Erhöhung der Transparenz bezüglich der Risikoangemessenheit von Ratings strukturierter Finanzprodukte. Since the worldwide economic bust has broken out in 2007, an extensive debate in politics, the media and the economic science about the role and regulation of ratings agencies has evolved. This paper focuses explicitly only on one aspect of this debate, that is to say the role and regulation of ratings agencies in the context of their evaluation of structured finance products. Based on a game theoretical model this paper shows, that the interaction of ratings agencies and issuers during their development and evaluation of structured finance products can be reconstructed as a classical prisoners’ dilemma. Within this dilemma the ratings agencies produce purposefully inflated ratings and the issuers apply purposefully inadequate processes while developing the structured finance products. In order to resolve this dilemma this study proposes a simultaneous regulation of the ratings agencies and the issuers allowing for a gain in welfare for both the ratings agencies and the issuers while implementing the socially desired condition. Based on these findings this paper identifies three levers for an effective regulation of the ratings agencies in the context of their evaluation of structured finance products: (a) reduction and elimination, respectively, of the so called ratings shopping; (b) reduction of the number of ratings agencies - if so even the establishment of a monopoly; (c) enhancement of the transparency regarding the performance of credit rating of structured finance products.
